Terms of Service
Please read these terms carefully before using Elfenfarm

1. Introduction
These Terms of Service ("Terms") govern your access to and use of the Elfenfarm platform ("Service"), operated by Elfenfarm ("we", "us", "our"). By registering for an account or using the Service, you agree to be bound by these Terms and our Privacy Policy.
2. Definitions
- "Organization" means the legal entity that registers for and uses the Service.
- "User" means any individual authorized by an Organization to access the Service.
- "Content" means any text, documents, responses, or other material uploaded to or generated through the Service.
- "Platform" means any third-party social media service (e.g., Reddit, LinkedIn, Mastodon, YouTube) that the Service interacts with.
3. Eligibility & Registration
- The Service is available to registered organizations only. Individual use is not supported.
- Upon registration, each Organization must provide an Organization Profile describing its mission and intended use of the Service.
- We reserve the right to review and approve or reject trial requests at our sole discretion.
- We reserve the right to provide the Service exclusively to established institutions, organizations, or companies whose philosophy and mission align with the Elfenfarm Charter.
- You must provide accurate, complete, and current registration information.
- You are responsible for maintaining the confidentiality of your account credentials.
4. Acceptable Use Policy
You agree to use the Service only for lawful purposes consistent with your declared Organization Profile. Specifically, you agree to:
- ✓ Use the Service to contribute constructive, fact-based responses to public discussions.
- ✓ Provide accurate and verifiable source documents for your knowledge base.
- ✓ Review and approve all AI-generated responses before publication.
- ✓ Comply with all applicable platform terms of service and API usage policies.
- ✓ Disclose AI-assisted content as required by platform guidelines.
- ✓ Respect rate limits and posting guidelines of all connected platforms.
5. Prohibited Activities
The following activities are strictly prohibited and constitute grounds for immediate suspension or termination:
- ✗ Trolling, provoking, or deliberately derailing conversations.
- ✗ Publishing hate speech, discriminatory content, or content promoting violence.
- ✗ Harassment, bullying, or targeted intimidation of any individual or group.
- ✗ Spreading misinformation, disinformation, or deliberately misleading content.
- ✗ Calls to violence or incitement of any kind.
- ✗ Impersonation of other organizations, individuals, or government entities.
- ✗ Using the Service in a manner inconsistent with your declared Organization Profile.
- ✗ Attempting to circumvent platform detection, rate limits, or API restrictions.
- ✗ Reselling, sublicensing, or providing unauthorized access to the Service.
6. Content & Intellectual Property
- You retain ownership of all documents and source materials you upload to the Service.
- You grant us a limited license to process your documents for the purpose of generating responses.
- AI-generated responses are provided for your review. You are responsible for all content you choose to publish.
- We do not claim ownership of content generated through the Service.
- We do not assume any responsibility for content published by organizations through the Service. Organizations are solely responsible for all posts, responses, and materials they choose to publish via connected platforms.
7. Subscription & Cancellation
- You may cancel your subscription at any time through the Elfenfarm platform.
- Upon cancellation, your subscription will remain fully active until the end of the current billing period. No prorated refunds will be issued for partial periods.
- After the billing period ends, your organization's access to the Service will be suspended. Organization administrators will retain login access to manage the account or reactivate the subscription.
- You may reactivate your subscription at any time before or after the billing period ends by revoking the cancellation through the platform.
- Your data will be securely retained for a period of twelve (12) months following the end of your subscription. After this retention period, data will be deleted in accordance with our Privacy Policy.
- We will notify you by email when your cancellation has been confirmed and when your subscription period has ended.
8. Account & Organization Deletion
8.1 User Account Deletion
- Any User may request deletion of their own account through the platform at any time.
- Upon requesting deletion, a 30-day grace period begins during which the request can be cancelled.
- After the grace period, the account and all personally identifiable data will be permanently deleted.
- An Organization Administrator cannot delete their own account if they are the sole administrator of an Organization. In such cases, another administrator must be designated first, or the Organization must be deleted.
8.2 Organization Deletion
- Organization Administrators may request deletion of their Organization through the platform.
- Two deletion modes are available:
- End of billing period: The Organization will be deleted when the current subscription period expires. The Service remains fully accessible until that date.
- Immediate (30-day grace period): The Organization is scheduled for deletion after a 30-day grace period, during which the request can be cancelled.
- No prorated refunds will be issued for any remaining paid subscription period, regardless of the deletion mode chosen.
- Upon Organization deletion, all associated data will be permanently removed, including campaigns, documents, monitoring data, AI-generated content, platform connections, and user accounts.
- Contributors and other Users will be notified before their accounts are deleted as part of an Organization deletion.
8.3 Data Retention After Deletion
- Certain records are retained after account or Organization deletion for legal and compliance purposes, including: consent records, financial transactions (invoices, payments), and security-relevant audit logs.
- These retained records are anonymized where possible and stored in accordance with applicable data protection regulations.
- Retained records will be kept for the minimum period required by law (typically 10 years for financial records, as required by Swiss and EU regulations).
9. Audit Logging
- We maintain an audit log of security-relevant actions for legal compliance, fraud prevention, and dispute resolution purposes.
- Logged actions include, but are not limited to: account registration, consent acceptance, subscription changes, financial transactions (invoices, payments), account and Organization deletion requests, and administrative actions.
- Audit log entries relevant to legal obligations (consent records, financial transactions) are retained beyond the lifetime of the associated account or Organization, as required by applicable law.
- Audit logs are accessible only to authorized system administrators and will not be shared with third parties except as required by law.
10. Content Moderation & Progressive Enforcement
10.1 Automated Content Review
All user-submitted content — including uploaded documents, manually written responses, and campaign position summaries — is automatically reviewed for compliance with these Terms and the Elfenfarm Charter. This review is performed using AI-assisted analysis and may flag content that violates our policies.
Content is evaluated against the Prohibited Activities listed in Section 5, including but not limited to: hate speech, misinformation, harassment, trolling, calls to violence, impersonation, and spam.
10.2 Progressive Flagging System
If submitted content is found to violate our policies, the following progressive enforcement measures apply:
User-level flags:
- Each policy violation results in a flag on the User's account.
- The Organization Administrator is notified of each flag via email and in-platform notification.
- After accumulating three (3) active flags, the User's content submission privileges are suspended ("content-blocked"). The User may no longer upload documents, create manual responses, or edit campaign summaries until unblocked.
Organization-level flags:
- An Organization receives a flag when:
- An Organization Administrator's own content violates the policy; or
- An Organization Administrator unblocks a previously flagged User.
- After accumulating three (3) active Organization flags, the entire Organization's content submission privileges are suspended.
- Only an Elfenfarm system administrator can unblock a suspended Organization.
10.3 Unblocking
- Users may be unblocked by their Organization Administrator. However, each unblock action results in a flag on the Organization.
- Organizations may only be unblocked by an Elfenfarm system administrator after review.
10.4 Flag Expiry
- Flags expire after twelve (12) months from the date of issuance (rolling window).
- Only active (non-expired, non-resolved) flags count toward the blocking thresholds.
- Resolved or expired flags are retained in the audit log for compliance purposes.
10.5 Evidence Preservation & Audit Trail
- When content is flagged, a copy of the flagged text is preserved as evidence, even if the original content is subsequently edited or deleted.
- All moderation actions (flags, blocks, unblocks, resolutions) are recorded in the audit log as described in Section 9.
11. Enforcement & Termination
- We reserve the right to monitor content published through the Service for compliance with these Terms and the Elfenfarm Charter.
- Violations may result in warnings, temporary suspension, or permanent termination of your account.
- In case of severe violations (hate speech, calls to violence, impersonation), we may terminate your account immediately without prior notice.
- Upon termination, your access to the Service will be revoked and your data will be handled in accordance with our Privacy Policy and Section 8 of these Terms.
- You understand and acknowledge that your Organization's account may be terminated if you violate these Terms of Service, the Elfenfarm Charter, or any other applicable agreements.
12. Platform Compliance
Elfenfarm uses official APIs to interact with third-party platforms. You acknowledge that:
- Each platform has its own terms of service that must be respected.
- Platform features and API access may change without notice.
- We are not responsible for actions taken by platforms against your accounts.
- Where required, automated content will be labeled as AI-assisted.
13. Limitation of Liability
- The Service is provided "as is" without warranty of any kind.
- We are not liable for the accuracy, completeness, or suitability of AI-generated responses.
- We are not liable for any actions taken by third-party platforms in response to content published through the Service.
- Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
